A BILL to amend and reenact §17C-16-8 of the Code of West Virginia,
1931, as amended, relating to creating a felony offense for
making, issuing or using counterfeit auto inspection stickers;
and providing a penalty for such violation.
Be it enacted by the Legislature of West Virginia:
That §17C-16-8 of the Code of West Virginia, 1931, as amended,
be amended and reenacted to read as follows:
ARTICLE 16. INSPECTION OF VEHICLES.
§17C-16-8. False certificates.
(a) No person shall make, issue or knowingly use any imitation
or counterfeit of an official certificate of inspection.
(b) No person shall display or cause or permit to be displayed
upon a vehicle any certificate of inspection and approval knowing
the same to be fictitious or issued for another vehicle or issued
without an inspection having been made.
(c) Any person convicted of a violation of this section for
making or issuing an imitation or counterfeit official certificate
of inspection is guilty of a felony and, upon conviction thereof,
shall be fined not more than one thousand dollars or imprisoned in
a state correctional facility not less than one year, or both fined
and imprisoned.
(d) Any person convicted of a violation of this section for
knowingly using an imitation or counterfeit of an official
certificate of inspection shall be punished according to the
provisions of section one, article eighteen of this chapter.
